The HomFax™ Warranty

Published in full, in plain language, before you ever sign anything. Every term below — including what this warranty does not cover and the exclusivity condition that keeps it free — is stated here rather than buried in a contract you read once.

1. Who is covered

This warranty is issued by HomFax™, a Regulus Development Corporation company, to the owner of the property on which HomFax supervised the covered work. It applies to residential roofing work completed under a HomFax work agreement and subject to HomFax quality-assurance supervision from beginning to end.

Coverage begins on the date the work is certified complete under that agreement and, subject to the conditions in this document, continues for as long as you own the property.

2. What is covered

HomFax warrants the work against defects in craftsmanship and defects arising from material cause. If covered work fails because it was installed incorrectly or because the material itself failed, HomFax will make it right.

Included as standard

  • Lifetime comprehensive maintenance program, including post-storm inspection visits after damaging storms.
  • 1-year performance visit — minor sealing, minor paint touch-up as required, re-sealing of any loose shingles, and replacement of individual wind-affected shingles within a minor scope.
  • End-of-life extension — once the shingles reach service life without major damage, a light-coat full-roof seal applied free of charge to extend shingle life and guard against water intrusion.
  • Significant repairs falling outside the minor scope above are offered at discounted rates.

3. The lifetime maintenance program

Most roofing warranties are passive: something fails, you notice it, you call. Ours is active. After a damaging storm affects your area, HomFax comes out and inspects — whether or not you have called us, and whether or not you believe anything is wrong.

The reason is documentation. Damage that is found and recorded early is provable later. Damage discovered two years on, after a second and third storm have passed over the same roof, is frequently attributed to wear and denied. Post-storm inspection visits exist to create the record while it can still be established.

Inspection findings are sealed into your property's HomFax record with a cryptographic hash and a timestamp, so the condition of your roof on a given date can be demonstrated rather than recalled.

4. The end-of-life roof seal

When your shingles reach the end of their rated service life without having sustained major damage, HomFax applies a light-coat full-roof seal at no cost to you. The purpose is to extend the usable life of the existing roof and maintain protection against water intrusion.

This benefit is provided without charge under the terms of this warranty. It is not a replacement roof and does not extend any manufacturer's material warranty.

5. The exclusivity condition

Stated plainly

The free maintenance program and the free end-of-life seal remain in force while you maintain HomFax as your exclusive provider for roof services, repairs, future replacements, and the handling of any future insurance claim on the property.

If work covered by this warranty is performed by another contractor, or a covered insurance claim on the roof is handled by another party, the free-of-charge benefits described in sections 3 and 4 end as to the affected work.

We state the reason rather than leaving you to guess it. A warranty on craftsmanship is a promise about work we supervised and documented. Once another party alters, repairs, or replaces that work, we can no longer stand behind a roof whose condition and history we did not record. The exclusivity is what makes the lifetime commitment possible at no charge.

What this condition does not do: it does not prevent you from obtaining other estimates, other opinions, or independent legal or professional advice at any time. It does not require you to accept any price we quote. It does not oblige you to bring us a claim, and choosing not to does not make you liable to us for anything. The consequence of using another provider is limited to the ending of the free benefits described above — it is not a penalty, a fee, or a debt.

Insurance claim handling — read this carefully

HomFax holds Texas insurance licences (Adjuster #3277221, Public Adjuster #3473995). Where this warranty refers to the handling of an insurance claim, that is a service we are licensed to perform and would be engaged to perform under a separate written agreement that complies with Chapter 4102 of the Texas Insurance Code. Nothing in this warranty appoints HomFax as your public adjuster. That engagement requires its own contract, signed separately, which you may cancel as provided by law.

6. What is not covered

A warranty that claims to cover everything is not a warranty. These are the limits:

  • Damage from a new peril occurring after completion — a subsequent hailstorm, windstorm, fire, falling tree, or impact. These are insurance events, not craftsmanship defects. We will document and pursue them; they are not warranty repairs.
  • Work performed, altered, or repaired by anyone other than HomFax or a HomFax-supervised contractor.
  • Damage caused by alterations to the structure — satellite dishes, solar arrays, HVAC units, antennas, or penetrations added after completion by others.
  • Failure caused by pre-existing conditions outside the scope of the completed work, including decking, framing, or ventilation defects that were identified and declined for repair.
  • Neglect, including failure to permit reasonable access for the maintenance visits this warranty provides.
  • Cosmetic variation in colour, granule distribution, or weathering that does not affect performance.
  • Damage from ponding water caused by structural deflection not attributable to the covered work.
  • Consequential or incidental damages, to the extent that limitation is permitted by law — see section 9.

7. Transfer on sale of the home

This warranty runs with your ownership of the property. On sale, the remaining craftsmanship coverage may be transferred once to the buyer at no charge, provided HomFax receives written notice within 30 days of closing.

The free maintenance program and the end-of-life seal are offered to the new owner on the same terms, including the exclusivity condition in section 5, if the new owner elects to continue them. A buyer who declines is not bound by section 5 and retains the craftsmanship coverage.

8. How to make a warranty claim

  2. 2We schedule an inspection. There is no charge for a warranty inspection.
  3. 3Findings are documented and sealed into your property record, and you receive a copy — including where we conclude the cause is not covered, and why.
  4. 4Covered defects are repaired at no cost to you. Where the cause is a new peril rather than a defect, we tell you so plainly and explain the insurance route.

Texas law gives a contractor notice and an opportunity to repair before certain construction claims may proceed (Texas Property Code, Chapter 27). Contacting us first is not merely a courtesy — it protects your position.
