Privacy Policy

The short version

1. Who we are

This policy applies to HomFax™, a trademark owned by Regulus Development Corporation ("HomFax," "we," "us"), and to homfaxtm.com and any HomFax application, portal, or form.

HomFax operates as a licensed Texas public insurance adjuster (Texas Department of Insurance licence #3473995). When we act as your public adjuster we represent you, the insured, only — and Texas Insurance Code §4102.153 prohibits us from divulging information obtained in that role except as the law requires or as you direct.

2. Information we collect

Property records (from public sources)

We maintain a repository of property information assembled from records that are already public — principally county appraisal district rolls, recorded deeds, permit filings, and federal weather and flood data. This typically includes the property address, the owner of record's name and mailing address, assessed and market value, year built, living area, lot size, legal description, and hazard designations.

This is publicly available information as that term is used in the Texas Data Privacy and Security Act, and the county publishes it regardless of anything we do.

Contact information

We may hold telephone numbers and email addresses associated with a property owner. These come from you directly, from an inbound enquiry, or from licensed commercial data providers. Every contact record we hold carries its source, the date we obtained it, and its consent and do-not-call status — and we do not use a number or address that our compliance checks say we may not lawfully use.

Claim and inspection information (clients only)

Information you give us

Your name, contact details, property address, and anything you tell us in a call, form, email, or at your door.

Website and device information

Standard server logs (IP address, browser type, pages requested, timestamps) and, if you use our application, an authentication session token. [CONFIRM before publishing: whether analytics or advertising pixels are actually deployed — see §10.]

What we deliberately do not collect

We do not hold protected characteristics or credit data.

HomFax does not collect or store race, ethnicity, religion, national origin, familial status, disability, or any similar protected characteristic, and our systems reject any attempt to submit them. We also do not collect individual income, credit scores, or consumer credit reports. Property-level financial facts from public record — assessed value, tax delinquency, liens — are not the same thing and are not consumer credit information.

We do not use personal information to make automated decisions that produce legal or similarly significant effects about you, and we do not profile individuals for that purpose.

4. When we share information

We share personal information only in these circumstances:

We do not sell personal data, we do not share it for cross-context behavioural advertising, and we do not process it for targeted advertising or profiling as those terms are defined by the Texas Data Privacy and Security Act. We hold no biometric data and no sensitive personal data as defined by that Act.

5. Financial privacy — clients

As a licensee of the Texas Department of Insurance, we handle nonpublic personal financial information under the privacy rules that implement the federal Gramm-Leach-Bliley Act for insurance licensees (28 Texas Administrative Code Chapter 22).

We do not disclose nonpublic personal information about current or former clients to nonaffiliated third parties except as permitted by those rules or as described in this policy — principally to your insurer and to the parties necessary to process your claim and complete your repair. If we ever intend to disclose it for any other purpose, we will provide notice and a genuine opportunity to opt out before doing so.

6. Marketing, and how to make it stop

Where we contact property owners about our services, we do so under the following rules — and you can end it at any time.

Email homfaxtm@homfaxtm.com with the subject line "Privacy Request," or call (844) 466-3290. We will verify your identity — and if we cannot verify it by reasonable means, we will tell you rather than guess. We respond within 45 days, and may extend once by a further 45 days where reasonably necessary, telling you why before the first period ends. There is no charge for the first two requests in a twelve-month period.

If we decline — your right to appeal

Appeals

If we refuse a request, we will tell you why, and you may appeal by replying to that decision or emailing homfaxtm@homfaxtm.com with the subject "Privacy Appeal." We will respond in writing within 60 days explaining our reasoning.

If the appeal is denied, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov. We will provide that link with any denial.

Records held about a property rather than a person

Some information in our repository — the county's record of who owns a parcel, its appraised value, its permit history — is public record maintained by government bodies. We can remove it from our systems and suppress the address, and we will on request. We cannot change what the county publishes; corrections to the appraisal roll itself must be made with your appraisal district.

8. Universal opt-out signals

We honour recognised universal opt-out mechanisms, including Global Privacy Control (GPC), as a valid opt-out request from the browser that sends it.

10. Cookies, analytics and advertising

We use cookies that are strictly necessary to operate the site and keep you signed in. These cannot be switched off without breaking the service.

[CONFIRM before publishing] — If HomFax deploys analytics or an advertising pixel (for example Google Analytics, or the Meta pixel for Facebook or Instagram advertising), that must be disclosed here, naming the provider and what it collects, together with how to opt out. If no such tracking is deployed, delete this box and say so plainly instead — do not disclose tracking you do not perform.

Where we advertise on third-party platforms, those platforms operate their own tracking under their own privacy policies, and their controls apply in addition to ours. We do not upload client claim information to any advertising platform.

11. Security

Information is transmitted over encrypted connections and held on access-controlled systems. Inspection photographs and documents are cryptographically fingerprinted at capture so that any alteration is detectable — that integrity protection exists to make your evidence defensible, and it protects your privacy as a side effect. Access is limited to people who need it to do their job, and contact data access is logged.

No system is perfectly secure, and we will not pretend otherwise. If a breach affects your personal information we will notify you and the authorities as the law requires.

12. Children

Our services are for property owners and are not directed to children under 13. We do not knowingly collect their personal information. If you believe we have, contact us and we will delete it.

13. Changes to this policy

If we change this policy we will update the date at the top, and for material changes we will say so prominently on the site. Continuing to use our services after a change means the updated policy applies.
